Please read these Terms of Service ("Terms") carefully before using the Pingcord website and bot (the "Service") which is at pingcord.xyz and is operated and maintained by Scriptle Ltd. ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and other who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service and must cease access to the Service immediately.

License

We grant you a personal, non-transferable and non-exclusive right and license to use any necessary software used in connection with its services on any single computer at any given time, provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, decompile, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software. You agree not to modify the software in any manner or form, or to use modified versions of the software, including, without limitation, for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by Us for use in accessing the Service. And, you agree to not attempt to access areas of the Service which you are not permitted including attempting to breach/breaching the Service’s security measures. Furthermore, you agree to use the Service with the rate limits as defined for each part of the Service as defined. We reserve the right to terminate your access to any or all parts of the Service if you do not agree to this License.

Your account

You may wish to log in to the Service for a number of reasons, including a more personalised experience and to set up the Service for your own personal Discord guild. You may log in to the Service via third party authentication. Currently, this is done via Discord account authentication. Please refer to the Discord Terms of Service and Privacy Policy for further information. Furthermore, there is a further Facebook account authentication for access to the Service's Facebook integration. Please refer to the Facebook Terms of Service and Privacy Policy for further information. Any data requested via Discord or Facebook will be exclusively used in order to provide to you the Service.

Links to Other Web Sites

Our Service may contain links to third party web sites or services that are not owned or controlled by Us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the Terms of Service/Terms and Conditions and Privacy Policies of any third party web sites or services that you visit and/or use.

Termination

We reserve the right to terminate your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, indemnity and limitations of liability. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of The United Kingdom of Great Britain and Northern Ireland, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any part of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding Our Service, and supersede and replace and prior agreements we might have between Us regarding the Service. You and We both submit to the non-exclusive jurisdiction of The United Kingdom courts in relation to disputes arising in connection with these Terms or the Service. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms, provided that this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

Changes

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is significant, we will try to provide at least 30 days notice to any new terms taking effect. What constitutes a significant change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must cease access to the Service immediately.

Communication

We may communicate with you by email via the Service. You agree to receive email from us at the email address you provided to Discord when signing up for your Discord account. By using the Service or providing information to us, you agree that we may communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Service. Intellectual Property Rights

Unless otherwise indicated, all content and materials on the Service, including, without limitation, visual interfaces, graphics, design, compilation, information, computer code, text, pictures, information and other files (collectively "Materials") registered or unregistered are owned, controlled and licensed by Us. The Service and Materials as a whole are protected by United Kingdom Copyright Law (Copyright Designs and Patents Act 1988) and are proprietary property of Us. All rights are reserved by Us unless explicitly permitted in writing.

Third-Party Services

Due to the nature of the Service provided, We may need to connect to other third-party platforms to receive information about your tracked channels. These third-party services may require us to notify you of policies, as relevant from time to time.

YouTube

If you connect your YouTube account to your account on this Service, We remind you that you are bound by the YouTube Terms of Service , notwithstanding that you have agreed to be bound by those Terms when registering for a YouTube account.

Virtual Currency

The Service permits each user to obtain and store an amount of "credits", that requires you to pay a fee using real currency. The Virtual Currency can be used to purchase goods and services on this site. Your purchase of Virtual Currency and items purchased with the Virtual Currency is/are not refundable, exchangeable or transferable, except at Our sole discretion. All Virtual Currency and purchased items are sold and provided AS-IS with no warranties of any kind. Virtual Currency and items purchased using Virtual Currency cannot be transferred, redeemed or exchanged into real currency. You may not purchase, sell, or exchange Virtual Currency outside the Service. We reserve the right to modify, manage, control and/or eliminate Virtual Currency and items purchased using Virtual Currency at our sole discretion and shall have no liability to you or any third party for the exercise of such rights. The real currency payment fee at which Virtual Currency is acquired and the prices and availability of items purchasable by Virtual Currency are subject to change without notice. We reserve the right to remove all your Virtual Currency and/or disallow access to and remove items you have purchased using Virtual Currency including unused items at our sole discretion and We will have no liability to you for any such actions.

Any unspent Virtual Currency will expire after 1 year (365 days) of purchase. When you refund an integration back into Virtual Currency (as outlined in our Refund Policy), your 365 days will begin on the day that you refund the integration.

Indemnity and Limitation of Liability

In no event shall We or Our licensors be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, that result from the use of, or inability to use, this Service. We also shall not be held liable for any unauthorized access to or alterations to your transmission of data including hacking and tampering of your device and we reserve the right to terminate your access if such activities are in breach of these Terms. Furthermore, you agree to indemnify Us against all liabilities, claims and expenses that may arise out of (i) your access to the Service, (ii) breach of these Terms by your Account (whether you or a party who has access to your account).

We are fully committed to your privacy. For that reason, we have created and are adhering to this privacy policy which outlines what we do with your information. We proactively ensure that all the necessary steps are taken to safeguard your data. This website is compliant with The United Kingdom Data Protection Act 2018, and the European Union General Data Protection Regulation (EU-GDPR) 2016/679.

You personal data will be stored by Us and processed by Us and used by Us only. In certain cases we may pass on some pieces of information to our close affiliates in order to provide the Service to you effectively.

We use your personal data to:

Third-Party Services

Due to the nature of the Service provided, We may need to connect to other third-party platforms to receive information about your tracked channels, such as livestream notifications, upload alerts, new posts, etc.

Twitch

The Service makes use of the Twitch API to receive events programmatically from Twitch, and to retrieve details of livestreams and uploads.

The Service allows you to connect your Twitch account to your account on the Service. Event data includes livestream start/stop, new subscribers, and Bits messages which is processed according to your specified Integrations. We agree to only use the data obtained to provide you this Service.

Refer to the Twitch Privacy Notice if you make use of Twitch account linking on the Service.

TikTok

The Service makes use of the TikTok API to receive events programmatically from TikTok, and to retrieve details of posts.

As per TikTok's set-out conditions, you are required to link your TikTok account to your account on the Service should you wish to make use of the TikTok functionality of this Service. Event data includes information about your posts which is processed according to your specified Integrations. We agree to only use the data obtained to provide you this Service.

Refer to the TikTok Privacy Policy if you make use of TikTok functionality of this Service.

Meta

The Service makes use of the Meta API to receive events programmatically from Facebook & Instagram products, and to retrieve details of posts and livestreams.

As per Meta's set-out conditions, you are required to link your Facebook and/or Instagram account to your account on the Service should you wish to make use of the Facebook and/or Instagram functionality of this Service respectively. Event data includes information about your posts and/or livestreams which is processed according to your specified Integrations. We agree to only use the data obtained to provide you this Service.

Refer to the Meta Privacy Policy if you make use of Facebook and/or Instagram functionality of this Service.

YouTube

The Service makes use of the YouTube API Services to receive events programmatically from YouTube, and to retrieve details of uploads, premieres, and livestreams.

While YouTube account linking is not possible in the current versions of the Service, We remind you to refer to the Google Privacy Policy if you interact with the YouTube functionality of Our Service.

Information disclosure

We will never disclose any of your personal data without your permission unless:

  • We are legally required to do so (e.g. pursuant to a court order)
  • This site is acquired by a third party acquirer in which all data will be forwarded to them and their privacy policy will take effect instead of this one due to a change of owners
  • Email correspondence
  • We or Our close affiliates may send you emails for the following:
    • Emails confirming your actions on the Service when necessary
    • Service messages to notify you about planned maintenance
    • Notify you of changes to our privacy policy or terms and conditions
    • Request further information from you in order to send or provide you a physical or digital goods or services

We value your personal data. For this reason, we ensure that we have taken the necessary steps to safeguard your data from hackers and other unauthorised access and unlawful access. While no computer system can be impenetrable, we take appropriate security measures to ensure the likelihood of unauthorised access to be very low.

Please note that the security measures we implement is to protect our servers and databases from external access. It is your responsibility to ensure that your Discord and other 3rd party accounts are secure and that you log out at the end of each session if you are using a public computer. We accept no liability for your account being unprotected.

Please read this Refund Policy ("Policy") carefully before using the Pingcord website and bot (the "Service") which is at pingcord.xyz and is operated and maintained by Scriptle Ltd. ("us", "we", or "our").

Premium

"Pingcord Premium" is a monthly or yearly subscription service. The benefits and features of this subscription are explained clearly on the Service website.

Transaction Currency

The Service website supports three presented currencies (a.k.a. merchant-side), these are: British Pound Sterling (GBP), United States Dollar (USD), and the Euro (EUR). If your card is not one of the directly presented currencies, you can still make payments as your card issuer will convert it to your local currency (this may incur a fee known as a Foreign Transaction Fee). You can also use PayPal, which will convert it to your local currency. We are not liable for any fees from your card issuer or PayPal in relation to any transaction with us.

Credits

In order to obtain more integrations on the Service, you may purchase them using "credits" in the shop. You obtain credits by exchaning real money into the virtual currency on this Service ("credits"). Please refer to the Terms of Service for information regarding virtual currency and credits.

Integration refunds

You are entitled to refund integrations purchased with credits, back into credits. You cannot refund integrations that are given to a server for free (such as when a Discord server is added to Pingcord for the first time or we gift integrations to a Discord server).

Refunds

14-day money-back guarantee:

We offer a money-back guarantee should you be dissatisfied with the Service for 14 calendar days from the date of purchase, inclusive of the date of purchase. To qualify for this guarantee, you must:

  • contact us directly in our support Discord server linked at the very top, or by email to support@pingcord.xyz to notify us that you wish to receive a refund;
  • not have, at our sole discretion, made multiple refund requests within a short period; and
  • not have, at our sole discretion, made considerable use of the Premium Service for a temporary commercial event. Considerable use of the Premium Service for all other uses are included in the guarantee.

After 14 days:

We are still happy to consider refund requests should you be dissatisfied with the Service after this time. We invite you to contact us directly in our support Discord server linked at the very top, or by email to support@pingcord.xyz.

Your consumer rights are unaffected in accordance with United Kingdom and European Union Law.
